Right of Withdrawal

If you are a consumer and conclude a distance contract with Artist League, you are generally entitled to a right of withdrawal in accordance with the statutory provisions.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract was concluded. This corresponds to the statutory model for service contracts.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement, for example a letter sent by post or an email, of your decision to withdraw from this contract.

You may use the sample withdrawal form below for this purpose. However, use of the form is not mandatory.

If Artist League provides an electronic withdrawal function, you may also exercise your right of withdrawal via this function. After submitting a withdrawal via the electronic withdrawal function, you will immediately receive confirmation of the receipt of your withdrawal on a durable medium, for example by email. The statutory model provides for a corresponding notice if such a withdrawal function is to be provided.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you effectively withdraw from this contract, we shall reimburse to you the payments we have received from you in connection with the withdrawn contract without undue delay and no later than fourteen days from the day on which we received the notification of your withdrawal.

For this reimbursement, we will generally use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged any fees as a result of such reimbursement due to a deviating agreement.

In the case of a competition entry, you may want Artist League to begin the agreed service before the fourteen-day withdrawal period has expired, for example by processing, reviewing, or carrying out your competition submission.

If you expressly request that Artist League begin the service already during the withdrawal period, and you subsequently withdraw from the contract, you may, in accordance with the statutory provisions, be liable to pay a reasonable amount for the services already provided up to the time of withdrawal.

This amount generally corresponds to the proportion of the service already rendered up to the withdrawal in relation to the total scope of the agreed service. This wording corresponds to the addition to the statutory model withdrawal notice provided for services.

In the case of a paid service contract, the right of withdrawal may expire before the fourteen-day withdrawal period has elapsed if Artist League has fully performed the service and you, before the service began:

• expressly agreed that Artist League begin the service before the withdrawal period has expired; and
• confirmed your knowledge that your right of withdrawal ends once Artist League has fully performed the contract.

The right of withdrawal for a paid service contract therefore does not expire merely because a payment was made or a submission was uploaded. The decisive factors are the statutory requirements of § 356 (5) BGB.

If you wish to withdraw from the contract, you can use this form and send it to us. Use of the form is not mandatory.

The statutory sample withdrawal form contains in particular the recipient, the designated service, the order date, name, address, date, and, where applicable, signature.
